You may have heard that the bankruptcy laws changed and that now it is harder to file for
bankruptcy. This is true. Most people, however, can still file a Chapter 7 bankruptcy and
get a discharge of most debts. There are now a couple more hurdles to jump over before
you can receive this discharge and it will be more expensive than it once was...but despite
these changes it may still make sense for you to consider filing bankruptcy to help improve
your financial situation.
The new hurdles are a Credit Counseling course that must be completed before filing and
a Debtor Education Class that must be completed before you can receive a discharge in
People who make more than the median income in Oregon may (depending on their
expenses and debts) now be prohibited from Chapter 7 bankruptcy filings. However, even
if you fall into this category, a Chapter 13 (payment plan) bankruptcy filing may help you.
So, DESPITE the changes in the law, it may still be a good idea to consider bankruptcy.
