EVIDENCE BASED LEGAL ASSESSMENTS
Legal knowledge and expertise has been passed down
from professor to student, and a legal practice was highly
governed by a professor’s beliefs, inclinations,
experience and opinions. Long ago, this system worked
relatively well, but as time has passed, this system has
generated too many individual opinions. Opinions are
often based on feelings, inclinations, prejudices, and
sentiment. A legal opinion is an individual attorney’s
conclusion based on experience. The attorney may or
may not be able to justify the opinion and the opinion may
or may not be consistent with that of the remainder of the
legal community. Evidence based legal assessments is
the practice of assessing claims based on proven
results. Evidence-based assessments are thorough,
objective, understandable and defensible; based on
statutes, regulations, administrative rules and decisions.

An Evidence-Based Legal Assessment provides an
understandable explanation of how the history,
evaluations, findings and testing support the conclusion
of the assessment and may provide literature to support
the fact that the assessment is not an individual opinion,
but is in agreement with the statutes, regulations,
administrative rules and decisions.

We find ourselves working within a new world. The
presenting and processing of a claim is becoming
increasingly more complex, litigious and exacting. We are
all dealing with more complicated claims, increasing
frequency of litigation and increasing size of awarded
