AVOIDING PROBATE IN OREGON. In 2005,the Oregon probate laws were changed to allow estates withreal estatevalued atless than $150,000 to use the Oregon small estate probate procedure, whichis completed in one day, and is not costly in attorney fees. Therefore, less people now need expensive trusts if their estates are not large.
WILLS. Everyone should have a will to direct where their assets go, to choose a personal representative, and to avoid a bond fee. All wills go through probate, so if an estate is large, it may be wise to use a revocable trust.
TRUSTS. Revocable trusts avoid probate, but are more costly, and more difficult to administer.
JOINT OWNERSHIP. Joint ownership with a spouse avoids probate, but do not add children as joint owners with survivorshipon your assets to avoid probate - if the child is sued, divorced, or bankrupted, you could lose your assets.
